2. Description of Service

Cloudjet is an email automation platform that allows users to:

• Create and manage email campaigns and sequences
• Send emails through connected SMTP accounts
• Track email performance and analytics
• Manage leads and contacts
• Integrate with Gmail and Outlook via OAuth

3. User Accounts

3.1 Account Creation

You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Security

You are responsible for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

4. Acceptable Use

You agree not to use the Service to:

• Send spam, unsolicited, or illegal emails
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit viruses, malware, or harmful code
• Harass, abuse, or harm others
• Impersonate any person or entity
• Interfere with or disrupt the Service
• Use the Service for any fraudulent or illegal purpose

5. Email Sending and Compliance

5.1 Email Compliance

You are responsible for ensuring that all emails sent through the Service comply with applicable laws, including but not limited to:

• CAN-SPAM Act (United States)
• GDPR (European Union)
• CASL (Canada)
• Other applicable anti-spam and data protection laws

5.2 OAuth Integration

When you connect your Gmail or Outlook account via OAuth, you grant us permission to send emails on your behalf. You can revoke this access at any time through your Google or Microsoft account settings.

5.3 Rate Limits

We may impose rate limits on email sending to prevent abuse and ensure service quality. You agree to comply with these limits.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by Cloudjet and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7. User Content

You retain ownership of all content you create, upload, or transmit through the Service. By using the Service, you grant us a license to use, store, and process your content solely for the purpose of providing the Service.

8. Payment and Billing

If you subscribe to a paid plan, you agree to pay all fees associated with your subscription. Fees are billed in advance and are non-refundable except as required by law.

9. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. We reserve the right to modify, suspend, or discontinue the Service at any time.

10. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties.

You may terminate your account at any time by contacting us or using the account deletion feature in your settings.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLOUDJET SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

13. Indemnification

You agree to indemnify and hold harmless Cloudjet, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service or violation of these Terms.

14. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes by posting the updated terms on this page and updating the "Last Updated" date.

15. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction in which Cloudjet operates, without regard to its conflict of law provisions.
